Welcome to TrailParcelDune ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at trailparceldune.sbs (the "Service") operated by TrailParcelDune.
By booking a charter or using our Service, you consent to adhere to these Terms. Should you not agree with any section of these terms, you must refrain from using the Service.
2. Service Overview
TrailParcelDune offers a range of high-end yacht charters which include:
- Yacht rentals for the day
- Evening boat tours
- Business getaways
- Exclusive parties
- Extended sailing trips
All offered services are dependent on availability and weather circumstances. We hold the authority to alter or halt services as necessary.
3. Booking and Reservations
3.1 Booking Process
When booking a charter you must:
- Be of minimum 18 years of age
- Provide truthful and thorough information
- Make a deposit payment as indicated in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A charter reservation is only considered confirmed after we receive payment and send out a confirmation in writing. We reserve the right to decline service to anyone at our discretion.
3.3 Availability
Charters depend on the accessibility of the vessel and favorable weather conditions. We shall endeavor to accommodate your requests for specific dates and times.
4. Payment Terms
4.1 Pricing
All pricing details are expressed in € and are inclusive of all applicable taxes unless stated differently. Rates are liable to changes without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the entire cost of the charter, due upon reservation
- Remaining balance: To be paid 48 hours prior to the charter's commencement
- Any additional fees (if applicable): To be settled at the conclusion of the charter
4.3 Payment Methods
Payments through major credit cards, bank wire transactions, and certified cheques are accepted. All payments are processed using secure and encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Above 72 hours before departure: Full reimbursement excluding service charges
- Between 24 to 72 hours before departure: 50% refund
- Within 24 hours of departure: No reimbursement
5.2 Weather Cancellations
Should weather conditions be deemed hazardous by our captain, we will propose either:
- Rescheduling your charter without extra costs to an upcoming date
- A complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
In case there are mechanical issues with the assigned yacht, an attempt will be made to offer an appropriate substitution. If we cannot provide an alternative, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Comply with instructions from the crew
- Utilize safety gear when needed
- Inform us of any health conditions that may impact their welfare
- Stay within allotted areas on the vessel
6.2 Prohibited Items
The following items are not permitted aboard:
- Containers made of glass
- Unlawful materials
- Weapons or firearms
- Excess drinks beyond a reasonable quantity for consumption
- Pets, unless they have received prior authorization
6.3 Conduct
Passengers are expected to behave in a courteous manner. We reserve the right to end a charter prematurely with no refund if a passenger's actions pose a risk to everyone's safety or disturb the serenity of other guests.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the cost paid for the cruise. We shall not be liable for:
- Injury due to passenger carelessness
- Theft or harm to personal effects
- Indirect, consequential, or punitive damages
- Delays attributed to weather or situations beyond our control
7.2 Insurance Coverage
Comprehensive maritime insurance that encompasses our fleet and operations is maintained by us. It is the passenger's responsibility to have personal and travel insurance in place.
7.3 Assumption of Risk
By partaking in our charter services, you acknowledge the innate dangers associated with marine activities and take on responsibility for your safety and well-being.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, journey paths, or schedules considering meteorological factors, safety needs, or operational exigencies. Efforts will be exerted to furnish comparable alternatives should changes occur.
9. Force Majeure
Occurrences beyond our capacity to control that result in postponements, annulments, or alterations are not our responsibility. These include but are not limited to:
- Severe climatic events
- Natural catastrophes
- Governmental commands
- Closures of ports
- Technical failures
10. Privacy and Data Protection
We process your personal data in accordance with our Privacy Policy. Utilizing our services implies your approval for the gathering and usage of your data as detailed within our Privacy Policy.
11. Intellectual Property
The entirety of the content on our website, which includes texts, visuals, insignias, and photographs, is safeguarded by copyright and trademark regulations. Unauthorized duplication, dissemination, or creation of derivative content requires our explicit consent.
12. Governing Law
The laws that apply in Germany govern these Terms. Any arising disputes will be settled in the judicative courts of Hamburg, Germany.
13. Changes to Terms
